BY-LAW REGULATING PARKING ON BISHOP’S UNIVERSITY CAMPUS
SECTION 1 — DECLARATORY AND INTERPRETATIVE STIPULATIONS
1. Definitions
1.1 For the purpose of the present By-Law, the hereunder-mentioned words and expressions are defined as follows:
1.2 The expression "pedestrian" designates a person who is circulating on foot, in a wheel chair (motorized or not).
1.3 The expression "public road" designates the surface area of land or construction, the maintenance of which is the responsibility of the University and on part of which are established one or many lanes which are opened to the public circulation of road vehicles, and, as the case may be, one or many bicycle lanes (trails);
1.4 The expression "parking space" designates the part of the roadway or of a parking lot, which is used to park a road vehicle;
1.5 The expression "parking lot" designates a piece of land or a private or public building which is reserved for the parking of road vehicles; on the Campus, parking lots are numbered as follows: P 1 to P 10 and include spaces which are identified "RESERVED";
1.6 The expression "Security Department" designates Bishop’s University’s Security Department;
1.7 The expression "road vehicle" designates a motorized vehicle, which can circulate on a road. Are excluded from road vehicles those which may circulate only on rails, as well as electrically driven wheelchairs; trailers, semi-trailers, and removable axles are considered road vehicles;
1.8 The expression "delivery zone" designates the part of the road which is adjacent to the boundary of such road, which is marked by signs, and which is reserved to the loading or unloading of merchandise;
1.9 The expression "unloading zone" designates the part of the road which is adjacent to the boundary of such road, is marked by signs, and which is to be used only to allow passengers to board or to get off a vehicle;
1.10 The expression "campus" designates all roadways, parking spaces and lots which are located on the property of Bishop’s University;
1.11 The expression "student" designates all persons who are registered as taking one or many courses at Bishop’s University or at Champlain College;
1.12 The expression "employee" or "Faculty" designates any person who is not a registered student, and who receives remuneration for services rendered to Bishop’s University, to Champlain College or to students.
SECTION 2 — TRAFFIC
2. Traffic
2.1 Prohibited dangerous driving
On Campus, any vehicle which is driven at a speed, or which causes a situation which is endangering the life or security of persons or properties is prohibited.
2.2 Obligations of the person who is driving a vehicle
Without limiting the scope of article 3.1 or stipulations of the "Code de sécurité routière" which regulate traffic, any person who is driving on Campus must:
a. comply with road signs that are thereon installed;
b. respect the speed limit which is of 20 km/h on Campus roads; and
c. give priority to pedestrians.
2.3 Obligations of pedestrians
Pedestrians must conform to stipulations of the "Code de sécurité routière" which apply to pedestrians.
SECTION 3 - PARKING
3. Parking
3.1 Municipal By-Law and penalties
The stipulations of By-Law No. 1 of the Ville de Sherbrooke which regulate parking, as well as Article 388 of the "Code de sécurité routière"(1) are applicable in full within the boundaries of the Campus by virtue of an agreement with the Municipality to that effect, and penalties which apply to offenders in the present By-Law are those which appear in the Municipality’s regulations. Fines and fees are payable to the Municipal Court, C.P. 1614 130 Rue Frontenac , Sherbrooke (Québec) J1H 5M4, at "Caisses populaires Desjardins", as well as at their instant tellers.
(1) Article 388 concerns parking spaces, which are reserved exclusively for physically, challenged persons.
3.2 Parking lots
Parking lots on Campus are designated as follows:
a. P 1 – Sports Complex
b. P 2 – In front of the tennis courts, between tennis courts and hangar, behind Paterson and near Abbott.
c. P 3 – In front of the " Pub "
d. P 4 – Beside the arena
e. P 5 – Between the " Morris House " building and the Champlain College building
Mondays to Fridays, between 8:00 A.M. and 4:00 P.M., for holders of "A" permits only
f. P 6 – Behind the Library on the " Divinity House " side. Mondays to Fridays, between 8:00 A.M. and 4:-00 P.M., for holders of "A" permits only.
g. P 7 – Behind the Library on the side of the "Workshop". Mondays to Fridays, between 8:00 A.M. and 4:00 P.M., for holders of "A" permits only
h. P 8 – In front of the "Johnson", "Hamilton" and "Nicolls" buildings Mondays to Fridays, between 8:00 A.M. and 4:00 P.M., for holders of "A" permits only
i. P 9 – Behind the " Norton ", " Bandeen" and " Pollack" buildings. Service vehicles and handicap vehicles only.
j. P 10 – Behind " Divinity House " building. Mondays to Fridays, between 8:00 A.M. and 4:00 P.M., for holders of "A" permits only
k. Adjacent to the "unloading zone" near the Mackinnon building, for holders of "A" permits only
l. Adjacent to the "unloading zone" near the Library, for holders of "A" permits only
3.3 Prohibited Parking
Parking is prohibited, at all times, on one or both sides of streets and sidewalks, on lawns, in entrances to buildings, on pedestrian trails, in priority zones, in marked out zones, in unloading zones, in accesses to parking areas, as well as in spaces which are reserved for physically challenged persons, without a permit to that effect.
3.4 Duration of Parking
The University may determine the duration of parking on public roads and in parking lots which are located on its Campus.
3.5 Parking areas reserved for motorcycles
The University may reserve spaces for the parking of motorcycles. Such spaces for the parking of motorcycles are:
a. P 1 parking lot – Sports Complex.
3.6 Free Parking
The University may authorize free parking on certain days of the year, during gatherings, religious, national or patriotic celebrations or other events of the kind, or on the occasion of processions or parades, and this, at set hours.
3.7 Unloading Zones
The University may reserve locations where busses or taxis may stop and park to allow passengers board or get off their vehicles, or to wait for said passengers. Those zones are indicated with appropriate signs.
3.8 Delivery Zones
The University may reserve areas where vehicles may stop to load or unload merchandises. Those zones are indicated with appropriate signs.
3.9 Signs for emergencies or crisis
The Director of Security may establish, maintain, remove or modify signs, as he deems necessary, in order to protect the public in a case of emergency or crisis.
3.10 Emergency Powers
Notwithstanding the stipulations of the present By-Law, an employee of Bishop’s University’s Security Department may, in the case of an emergency or when exceptional circumstances so require, take any measure which is deemed necessary with regard to traffic or parking, including the removal (towing) of vehicles.
3.11 Powers and obligations of the Security Department
Members of Bishop’s University’s Security Department have the duty and power to enforce the stipulations of the present By-Law, as well as any other By-Law related to security on Campus. They also have the power to direct traffic.
3.12 Municipal tickets or Removal (towing) for infractions
A Security Officer may issue a municipal ticket or have a vehicle towed in contravention of the parking By-Law towed at the owners risk and expense.
3.13 Mandatory Permit
All persons wishing to park a vehicle on Campus, must obtain a parking permit or deposit the required amount of money in one of the "Pay and Park" machines and display the stub on the dashboard. The Security Department issues semester (3 semesters fall, winter and summer) and yearly permits.
Note: Students using the Pay & Park machines, Mondays to Fridays, between 8:00 am and 4:00 pm must use P1, P2, P3, and P4 only. First year students with pay & Park permits must use P1, P2 during above hours. The University reserves the right to verify its records to determine if a vehicle operator is a student or not.
Returning students living in Norton or Pollack may use P7 by obtaining the yearly NO/PO sticker that must be stuck on the windshield.
3.14 Parking Areas
Parking is authorized only in areas reserved for that purpose, as well as where signs authorize stops for short periods of time.
3.15 Free Parking
Parking is free only:
a. for suppliers whose service vehicles are adequately identified; and
b. in certain circumstances, which are determined by the University’s Management.
3.16 Reserved Spaces
The Security Department may, at all times, reserve parking spaces or temporarily requisition spaces that have already been reserved.
3.17 Schedules
Rates which are imposed by virtue of the present By-Law for parking spaces which require parking permits or which are controlled by "Pay and Park" machines, must be paid on the following days and at the following times, except on legal holidays:
a. Mondays to Saturdays, from 8:00 A.M. until 11:00 P.M.
SECTION 4 - PERMITS
4. Permits
4.1 Issuance and revocation of permits
The Security Department is solely authorized to issue permits which allows parking on Campus. The University may exceptionally refuse to issue a permit. The University may revoke a permit at any time.
The University reserves the right to remove from any person the privilege to circulate or park a vehicle on Campus, if that person does not comply with the present By-Law.
The "tag" which is issued with the parking permit remains the property of the University. Any modification or reproduction of that "tag", or use of said "tag" for purposes other than those which are provided for in the By-Law, invalidates the permit and may result in judiciary procedures.
4.2 Application for a permit
The person who applies for a year or semester permit must fill out the required form. The person must produce an identification document as well as the vehicle’s registration document, and must pay required fees. Members of the University’s personnel may send their permit application through internal mail. Students must personally go to a point of sale for such permits.
4.3 Periods of Validity
The semester permit is issued for one of the following periods: from September 01st until December 31st, or from January 01st, until April 30th or may 1st to August 31st.
The yearly permit is valid from September 01st until August 31st. Renewal starts at mid-August.
4.4 Family permits for more than one vehicle
Any person who wishes to register more than one vehicle may do so providing vehicles are registered in his/her name or in the name of the spouse. Only one permit is issued for all registered vehicles. The permit gives the right to park only one vehicle at a time. The "tag" which is issued with the permit must be displayed on the rearview mirror of the vehicle which is parked on Campus.
4.5 Changes in Vehicles or Additional Vehicle
The holder of a permit may change or extend the use of the permit to other vehicles which may be registered in the holder’s name, or in that of the spouse, by making a request to that effect at the Security Department.
4.6 Temporary Permit
The holder of a permit who can not use the registered vehicle, may obtain a temporary permit free of charges, for a duration of ten (10) days, for the replacement vehicle being used. No temporary permits will be issued for vehicles which are registered under a permit which covers more than one vehicle.
4.7 Display of the Permit or "Tag"
The "tag" must be displayed on the interior rearview mirror of the vehicle that is parked on Campus. In all other cases ("Pay and Park" stub, day permit, other short-term permits and special permits), "tags" must be displayed, as the case may be, on the rearview mirror or on the dashboard, where they can be easily read from outside the vehicle.
The holder of a permit who fails to follow this directive contravenes the present By-Law and is liable to penalties which are provided for in the By-Law No. 1 (and its amendments) of the Ville de Sherbrooke on the protection of persons and properties.
4.8 Reimbursement
The University may reimburse part of the price which corresponds to semesters which have not yet started to the holder of a permit who must remit, prior to the beginning of such semesters, the "tag" and the permit.
4.9 Non-Transferable
Subject to the stipulations of Article 4.4 of the present By-Law and on pain of penalties which are provided for in By-Law No. 1 of the Ville de Sherbrooke (and its amendments) on the protection of persons and properties, the holder of a semester or yearly permit does not have the right to transfer the said permit (and or "tag") to anyone, for any other vehicle which is not registered on the permit.
4.10 Lost or Stolen "Tag"
A lost or stolen "tag" may be replaced. The holder of the permit must go in person to the Security Department and fill out a declaration of loss or theft; the "tag" will then be replaced upon payment of the required fees.
4.11 Tariffs
The University’s Parking Committee establishes the parking tariffs.
SECTION 5 – PERMIT CATEGORIES
5. Permit Categories
5.1 " A " Permits
"A" permits are issued to professors and employees of Bishop’s University and Champlain College. Such permits allow parking, at all times, in all parking lots but do not guarantee a free space to their holders when required.
5.2 " B " Permits

"B" permits are issued to students of Bishop’s University and Champlain College that are not first year. Such permits allow parking at all times in the following parking lots:
a. P 1 - Sports Complex
b. P 2 - In front of the tennis courts,between tennis courts and hangar, behind Paterson, in front of Abbott
c. P 3 - PUB
d. P 4 - Arena.
After 4:00 P.M., Mondays to Fridays, holders of "B" permits have access to all parking lots available on Campus.
5.3 " N " Permits
"N" permits are issued to all Bishop’s University or Champlain College Professors who teach exclusively at night. Such permits allow access to all parking lots on Campus and this, after 4:00 P.M. only.
"N" permits are also issued to Bishop’s University and Champlain College students who are taking courses at night only. These permits give access to all parking lots on Campus, and this, after 4:00 P.M. only.
5.4 " R " Permits
" R " permits are issued to all persons who use the arena facilities and who are not part of categories mentioned in articles 5.1, 5.2 and 5.3 mentioned above. These permits give access to all parking lots on campus, and this, after 4:pm only.
5.5 " S " Permits
" S " permits are issued to members of the Sports Complex only, who are not part of categories mentioned in articles 5.1, 5.2, 5.3 and 5.4 mentioned above.
This type of permit allows parking at all times in the following parking lots:
a. P 1 - Sports Complex
b. P 2 - In front of the tennis courts, between tennis courts and hangar behind Paterson and near Abbott.
Mondays to Fridays, after 4:00 P.M., holders of "S" permits have access to all parking lots available on Campus.
5.6 " F " Permits
"F" Permits are issued to first year students of Bishop's University and Champlain college. Such permits allow parking at all times in P1 - Sports Complex and P2 - in front of tennis courts, between tennis courts and hangar behind Paterson and near Abbott, After 4:00 pm, Mondays to Fridays, holders of "F" permits have access to all parking lots on campus.
5.7 Contractors and their workers must pay their parking while on the campus and park their personal vehicles behind Paterson P-2.
SECTION 6 - ACCIDENTS, DAMAGES, THEFT
6.1 Accidents
Any person who is involved in a traffic accident on Campus must, without any delay, inform the Security Department.
6.2 Liability
The University is not responsible for damages caused to vehicles which are parked or are circulating on Campus, nor is it responsible for the theft of vehicles or of their contents.
SECTION 7 - APPLICATION OF THE BY-LAW
7.1 The Director of the Security Department, or his authorized representative, is responsible for the application of the present By-Law.
7.2 Security Agents and/or Parking Agents who could be hired to apply parking regulations on the Campus of Bishop’s University are named by the University in accordance with the regulations which appear in Bishop’s University’s employees’ manual.
SECTION 8 – PENAL STIPULATIONS
8.1 Security Agent and/or Parking Agent
Any person or representative of a person whose services are retained by Bishop’s University for the application of the By-Law regulating parking, is authorized to issue infraction notices for any infraction related to the present By-Law.
8.2 Continuous infraction
Should the infraction to an article of the present By-Law be carried on, that continuity constitutes, day after day, separate infractions.
8.3 You are ultimately responsible for your vehicle while it is on campus.
SECTION 9 – FINAL STIPULATIONS
9.1 Abrogation and Replacement
The present By-Law abrogates and replaces any other By-Laws which regulate parking on Campus, as adopted by Bishop’s University’s Parking Committee
